DUTY OF CARE MONTH: Tracking the evolution of Duty of Care for commercial fleet drivers in the UK

960 560 Stuart O'Brien

Over the last ten years, the landscape of commercial fleet management in the UK has undergone significant changes, particularly in the realm of duty of care. As society’s understanding of safety, wellbeing, and responsibility has evolved, so too has the emphasis on ensuring that commercial fleet drivers are provided with an environment that prioritises their health, safety, and overall welfare. Here we examine the pivotal changes in duty of care for these drivers over the past decade, based on input from delegates and suppliers at the Fleet Summit…

  1. Legislative Changes: The UK government has been proactive in revising and introducing legislation aimed at enhancing the safety of commercial drivers. Laws around driving hours, mandatory rest breaks, and periodic vehicle inspections have been tightened. The Corporate Manslaughter and Corporate Homicide Act 2007, for instance, holds businesses accountable for fatalities due to gross breaches in the duty of care, underscoring the legal imperatives behind ensuring driver safety.
  2. Technological Integration: The last decade has seen an explosion in the integration of technology within commercial fleets. Telematics systems, which monitor vehicle location, speed, and driver behaviour, have become commonplace. These systems aid in ensuring that drivers aren’t speeding, taking the most efficient routes, and adhering to rest breaks. Additionally, they play a pivotal role in accident prevention and response.
  3. Mental Health Awareness: There’s been a growing understanding that duty of care extends beyond just physical safety. Recognising the mental pressures and potential isolation faced by long-haul drivers, many companies have begun initiatives to support their drivers’ mental health, offering counselling services and creating platforms for community support.
  4. Training and Development: Investment in continuous driver training has surged. Beyond basic driving skills, training programmes now encompass fuel-efficient driving, handling challenging weather conditions, and managing on-road stress. This holistic approach ensures that drivers are well-equipped to handle the multifaceted challenges of their roles.
  5. Vehicle Advancements: Modern commercial vehicles come equipped with advanced safety features such as lane departure warnings, automatic emergency braking, and fatigue monitoring systems. These advancements, spurred by both technological developments and a heightened emphasis on duty of care, have made the act of driving safer than ever before.
  6. Environmental Considerations: The duty of care has expanded to encompass environmental responsibility. Fleet operators are now more considerate of their carbon footprint, leading to the adoption of electric vehicles and the implementation of eco-driving training, ensuring drivers operate their vehicles in the most environmentally friendly manner possible.
  7. Pandemic Response: The COVID-19 pandemic introduced unprecedented challenges for commercial drivers, from ensuring their safety during deliveries to managing lockdown restrictions. The duty of care saw fleet operators introducing rigorous vehicle sanitation protocols, providing PPE, and ensuring drivers had access to updated information and guidelines.

The past decade has witnessed a profound shift in the understanding and implementation of duty of care for commercial fleet drivers in the UK. What was once a predominantly physical and immediate concern has transformed into a comprehensive, multi-faceted commitment to the drivers’ overall well-being, reflecting societal advancements in our perception of care, responsibility, and the role of businesses in ensuring the same.

DUTY OF CARE MONTH: Understanding the obligations for fleet managers and choosing the best partners

960 640 Stuart O'Brien

In the realm of fleet management, Duty of Care represents a legal and moral obligation to ensure the safety and well-being of drivers and other road users. Given the critical nature of this responsibility, selecting the right Duty of Care suppliers and solutions is paramount. Here’s a guide to steer you in the right direction, based on input from Fleet Summit delegates and suppliers…

  1. Clear Understanding of Legal Obligations:
    • Legislation Comprehension: Familiarise yourself with UK laws concerning fleet management, such as the Health and Safety at Work Act, to understand your Duty of Care obligations fully.
    • Updates & Changes: Choose suppliers who are proactive in updating their solutions as legislation evolves.
  2. Range of Services:
    • Training Programmes: The right supplier should offer training modules to improve driver behaviour and safety.
    • Emergency Assistance: Ensure that solutions offer immediate support in case of accidents or breakdowns.
  3. Data-Driven Insights:
    • Telematics Integration: Modern Duty of Care solutions often integrate telematics data to monitor driving habits, which can be pivotal for identifying risky behaviours.
    • Customised Reports: Opt for suppliers who can provide detailed, customisable reports on driver behaviour, vehicle health, and other key metrics.
  4. Driver Well-being and Health Checks:
    • Regular Health Check-ups: Solutions should include or connect with services that perform regular health assessments of drivers.
    • Mental Well-being: Given the stress of the profession, solutions that also focus on the mental well-being of drivers can be invaluable.
  5. Vehicle Maintenance and Inspection:
    • Routine Inspections: The solution should facilitate or remind managers of regular vehicle inspections, ensuring that all fleet vehicles are roadworthy.
    • Breakdown Services: Quick-response breakdown services can be a crucial part of Duty of Care, minimising downtime and ensuring driver safety.
  6. User-Friendly Interface:
    • Accessibility: Managers should be able to access the system easily, whether through mobile apps or desktop interfaces.
    • Intuitive Dashboards: Dashboards should present data clearly, making it easy for fleet managers to discern patterns or issues.
  7. Reputation and Reviews:
    • Case Studies & Testimonials: Reputed suppliers will typically have testimonials or case studies showcasing successful implementations.
    • Industry Recommendations: Look for suppliers recommended by established fleet industry bodies or associations.
  8. Cost-effectiveness:
    • Transparent Pricing: Ensure there are no hidden fees and that you understand the pricing structure fully.
    • Return on Investment: Consider how the solution might result in long-term savings, whether through reduced accidents, lowered insurance premiums, or improved vehicle longevity.
  9. Scalability & Integration:
    • Integration with Current Systems: Ideally, the Duty of Care solution should integrate seamlessly with your existing fleet management systems.
    • Growth Consideration: As your fleet grows, the solution should be able to accommodate this expansion without major overhauls.
  10. Customer Support:
  • Dedicated Support: Opt for suppliers who offer dedicated, around-the-clock customer support for any issues or queries.

By evaluating Duty of Care suppliers and solutions against these criteria, UK fleet management professionals can ensure that they’re not only meeting their legal obligations but also fostering a safety-first culture within their operations.

INDUSTRY SPOTLIGHT: RAC Telematics & Duty of care

960 640 Guest Post

Telematics can support duty of care obligations by keeping records for regulatory purposes in a central, easy-to-reach place. The online portal enables businesses to prove they are meeting their obligations in the case of an accident. Telematics software can also support employers by identifying the length lone workers are on site, showing working hours, highlighting excessive speeding and vehicle health, and providing alerts in case of accident.

Thanks to the level of data coming out of a telematics system, employers with a mobile or remote workforce are able to execute risk profiling and establish where duty of care focus must be spent.

Telematics systems, such as RAC’s, produces driver benchmarking and driving risk scores based on telematics trip data. This information and scoring, identifies key areas where employers can deploy policies and training programmes to help keep its driver community safe.  Additionally, our system can monitor driver performance, highlight areas of risk and even alert employers in the event of an accident. This unique technology meets both operational and duty of care needs.
